Lorsqu’une personne décède, son patrimoine est transmis selon les règles en vigueur en matière de succession. Cependant, un individu peut anticiper la transmission de son patrimoine par une donation qui est le moyen juridique de transmettre tout ou partie de son patrimoine de son vivant. On comprend alors l’intérêt d’étudier de manière juridique les donations, et tout spécifiquement dans une dimension comparatiste impliquant les droits islamique, français et koweïtien. Cette étude a été abordée sous trois aspects. En effet, les différences et les similitudes entre les trois systèmes juridiques ont été étudiées tout d’abord quant à la qualification de la donation. Ensuite, ce sont les conditions de validité du contrat de donation qui ont été examinées. Enfin, le troisième aspect concerne le régime de la donation.
When a person dies, his/her inheritance is transferred by inheritance. However, during his/her lifetime, they may act with their property by any act of transfer of ownership, including donation ( Heba). A donation is a legal means through which a person can behave with all or some of his/her property during his life.Therefore, we see the importance of this subject of donation and the importance of studying this subject in terms of legal comparison with islam, and the kuwaiti and french laws, to find solutions to the legal questions raised by this contract. In this study, we will present three aspects to identify the similarities and differences between the three laws. Firstly, we will address the issue of the legal adaptation of the donation contract and then the subject of the conditions of the validity of this contract and finally what is the legal system to hold the donation.
