Cette étude examine notamment si les droits des utilisateurs de propriétéintellectuelle ainsi que ceux des titulaires de propriété intellectuelle peuvent être fondéssur la liberté d'expression, et si les créations protégées par la propriété intellectuellepeuvent être conçues non pas comme une propriété ou un investissement, mais plutôt, etavant tout, comme un discours. L'objectif d'une telle analyse est d'établir le degré et lamanière dont le droit à la liberté d'expression informe déjà et devrait informer davantageles règles de protection de la propriété intellectuelle en Europe et ses limites. This work is devoted to studying, in a systematic way, whether European IP regulation can(or even should) be conceived as a speech regulation, with the rights of not only IP users,but also those of IP holders being grounded in freedom of expression, and with IP subject-matter being conceived not as property or investment, but rather, first and foremost, asspeech. The purpose of such an analysis is in establishing the degree and the manner inwhich the right to freedom of expression already informs and should further inform thestructure of IP protection in Europe and its limits.
