Cette étude examine l'approche de la CPI en matière de complémentarité appliquée à l’Afghanistan. Elle démontre comment l'interprétation du principe de complémentarité par l'Afghanistan est affectée par un mélange de considérations politiques et de déficiences judiciaires qui ont empêché l'État de se conformer à son devoir de poursuites. La recherche remet également en question la mise en oeuvre de la complémentarité par la CPI. Elle explore ensuite la nécessité d'aller au-delà du régime du Statut de Rome pour poursuivre les crimes internationaux en Afghanistan. Des solutions alternatives, notamment des tribunaux mixtes et une commission d'enquête et de réconciliation, sont ensuite proposées afin de dépasser le régime du Statut de Rome dans l'intérêt de la réalisation de la justice en Afghanistan. The complementarity principle considered to be an appropriate tool to strike a balance between protection of the State’s sovereignty and the international community’s obligation to effectively prevent grave international crimes and end impunity for the most serious crimes. This study examines the ICC’s approach to complementarity applied to the State of Afghanistan. It demonstrates how Afghanistan’s interpretation of the complementarity principle is affected by a mixture of political considerations and judicial deficiencies which have impeded the State’s compliance with its duty of prosecution. The research also challenges the ICC’s implementation of the complementarity. Then it explores the need to go beyond the Rome Statute’s regime to prosecute international crimes in Afghanistan. Alternative solutions, including mixed tribunals and an investigation-reconciliation commission, are then suggested in order to surpass the Rome Statute’s regime in the interest of achieving justice in Afghanistan.
