Le discours préambulaire y contribue largement par sa fonction de légitimation des instruments internationaux, et, à travers les ressorts qu’il mobilise à cette fin – parmi lesquels l’intégration systémique des instruments internationaux et le recours à une terminologie axiologique –, par sa participation à la construction d’un discours des droits de l’homme. Face à ce constat, l’étude questionne les potentialités du discours préambulaire pour l’émancipation de la personne humaine. Une première approche révèle le rôle des préambules dans la motivation du juge international de protection des droits de l’homme. Par les ressources argumentatives qu’il contient, le discours préambulaire offre de multiples possibilités pour soustraire son office à la volonté des États. Néanmoins, l’importance et la nature de ses insuffisances, de même que les limites inhérentes à la fonction juridictionnelle, exigent des perspectives plus radicales. Critical theories of International Law highlight the participation of international law to various forms of subordination. The preambular discourse largely contributes to it by its role of legitimising international instruments and, through the means it mobilises to this end – including the systemic integration of international instruments and the use of axiological terminology –, by its participation in the construction of a human rights discourse. Faced with this observation, the study questions the potential of the preambular discourse for the emancipation of the human person. A first approach reveals the role of preambles in the motivation of the international judge of human rights protection. Through the argumentative resources it contains, the preambular discourse offers several possibilities for removing the judge's office from the willingness of the States. Nevertheless, the extent and nature of its shortcomings, as well as the inherent limits of the jurisdictional function, require that more radical perspectives be considered.
