La présente thèse s’interroge sur la question de savoir si, en l’état actuel du droit positif, il existe une catégorie juridique à part entière susceptible d’englober l’intégralité des demandeurs d’asile, indépendamment du type de protection internationale recherchée et permettant de reconnaitre dans leur chef un statut de protection autonome. L’évolution de la notion de « protection internationale » par le biais de l’interaction entre les différents régimes de protection de la personne permet la déconnexion de la recherche d’asile du statut de réfugié. Ceci ouvre la voie vers l’autonomisation conceptuelle du demandeur d’asile et l’identification d’un statut juridique qui lui soit propre. The asylum seeker, a person claiming international protection, is commonly viewed either through the prism of refugee status as a “candidate refugee” or as someone akin to other migrants deprived of a legal status in international law. This thesis asks whether, in the current state of positive law, there is a legal category in its own right that can encompass all asylum seekers, regardless of the type of international protection pursued, and that would allow them to be recognized as having an autonomous protection status. The evolution of the notion of “international protection” through the interaction of the different regimes of protection of the individual enables the disconnection of the search for asylum from the status of the refugee. This paves the way for an autonomous conceptual approach of the asylum seeker and for the elaboration of his own legal status.
