Elle a également son propre régime juridique créé de manière distincte des infractions de droit commun. Les fondements théoriques de cette différenciation nous mènent vers un questionnement de la signification de l’État actuel où les principes libéraux doivent primer dans le contexte actuel. Néanmoins, le niveau différent du respect des droits de l’Homme pour les personnes poursuivies pour des infractions terroristes nous oblige à interroger la doctrine des droits de l’Homme elle-même. À partir des fondements théoriques et historiques de la doctrine des droits de l’Homme et du changement de la signification de l’État, cette étude se concentre sur l’exemple de la Turquie, afin de voir s’il existe un régime spécifique au droit pénal et du respect des droits procéduraux pour les personnes jugées pour des infractions terroristes. Chaque élément lié au droit à un procès équitable et au droit à la liberté et à la sûreté dans la jurisprudence de la CourEDH est évalué pour trouver les éléments de réponse aux questions précitées. The current fight against terrorism has an impact on the formation of political and legal orders of States and supranational organizations. It has its own legal system, which is created in a different way than ordinary offences. Theoretical basis of this differentiation leads us towards a questioning of the signification of State in today’s world, where liberal values should predominate in the context of post-World War II. However, different level of respect for human rights of people investigated and prosecuted of terrorist offences raises questions about the human rights doctrine itself. Departing from historical and theoretical basis of human rights doctrine and the changing of the meaning of State, this study aims to focus on the example of Turkey, in order to observe if there is a specific legal system of criminal law and of respect for procedural rights concerning people tried of terrorist offences. Each element of the right to a fair trial and right to liberty and security developed in the case law of European Court of Human Rights is examined, in order to find the answer to the aforementioned questions.
