Or, au-delà de la production d’opinions juridiques musulmanes inédites, de nouvelles méthodes ont été créées et certaines ont été réactualisées à l’époque contemporaine. Cela prouve que le caractère novateur du droit islamique existe aussi en matière méthodologique et pas uniquement sur le contenu du droit. Ce renouveau méthodologique inclut un bouvlersement du centre de gravité de l’autorité herméneutique musulmane avec une diversification des acteurs du fiqh et de l’Ijtihād durant l’ère contemporaine. En effet, bien loin de se limiter aux seuls juristes mujtahidūn, comme dans le droit classique, désormais l’Ijtihād est pratiqué par des penseurs autonomes, par des États ou par des comités collectifs. À titre d’illustration l’Ijtihād Collectif est une nouveauté contemporaine en rupture avec la pratique historique de l’Ijtihād qui se faisait de manière individuelle. Tout comme l’Ijtihād étatique qui démontre à quel point les États sont devenus des nouveaux acteurs de l’Ijtihād et ont réformé le droit musulman sur de nombreux aspects, principalement en matière de droit de la famille, parfois en usant de subterfuges ou de manœuvres politiques, mais d’autres fois avec un sérieux certain et une ingéniosité non négligeable. D’autres outils herméneutiques plus pratiques, concrets et fonctionnels, qui se sont développés à l’époque moderne, témoignent de ce renouveau méthodologique, à l’instar de l’Ijtihād Éclectique, qui a souvent été appelé Takhayyur ou Talfīq, et que certains juristes ont aussi nommé Ijtihād Sélectif. Paradoxalement, certains juristes ou penseurs musulmans contemporains appartenant à des courants diamétralement opposés, des plus libéraux et réformistes au plus littéralistes et traditionalistes, utilisent les mêmes méthodes herméneutiques pour produire un renouveau du droit. C’est que nous retrouvons avec les mécanismes du « retour direct aux sources scripturaires » et celui de la réforme du droit musulman par la « réévaluation critique des ḥadīths ». La réactualisation et le renouvellement contemporains de logiciels herméneutiques médiévaux sont aussi une réalité importante qu’on constate notamment avec le cas de l’Ijtihād al-Maqāṣidī (téléologique). En effet, beaucoup d’auteurs voient dans la théorie classique des « Objectifs supérieurs de la Loi Islamique » la clé de voûte du renouveau du droit musulman à l’époque moderne. Mais beaucoup moins nombreux sont ceux qui ont produit sur le plan théorique une méthodologie herméneutique claire pour interpréter les textes et le droit à partir des Maqāṣid al-Sharīʿa. Notre thèse a ainsi pour objectif d’analyser les évolutions et novations méthodologiques de l’herméneutique juridique musulmane contemporaine en étudiant notamment un certain nombre de ses mécanismes de manière globale et approfondie. The question of the revival of islamic law has been the subject of a lot of research, but that of the evolution of hermeneutical methods upstream the legal production has for its part received less attention from the academic world. Indeed, beyond the production of new islamic legal opinions, new methods have been created and some have been updated in contemporary times. This proves that the innovative character of Islamic law also exists in methodological matters and not only in the content of the law. This methodological renewal includes a shift in the center of gravity of islamic hermeneutical authority with a diversification of fiqh and Ijtihād’s actors during the contemporary era. Actually, far from being limited only to mujtahidūn jurists, as in classical law, Ijtihād is now practiced by independent thinkers, by States or by collective committees. By way of illustration, the Collective Ijtihād is a contemporary novelty that breaks with the historical practice of Ijtihād which was done individually. Just like the Ijtihād of State which demonstrates to what extent the States have become new players in the Ijtihād and have reformed Islamic law on many aspects. Mainly in matters of family law, sometimes by using subterfuge or political maneuvers, but other times with a real seriousness and a significant ingenuity. Other more practical, concrete and functional hermeneutical tools, which have been developed in modern times, bear witness to this methodological renewal, like the Eclectic Ijtihād, which has often been called Takhayyur or Talfīq, and which some jurists have also named Selective Ijtihād. Paradoxically, some contemporary Muslim jurists or thinkers belonging to diametrically opposed currents, from the most liberal and reformist to the most literalist and traditionalist, use the same hermeneutical methods to produce a revival of the law. This is what we find with the mechanisms of the "direct return to scriptural sources" and that of the reform of Islamic law by the « critical reassessment of the ḥadīths ». The contemporary updating and renewal of medieval hermeneutical tools is also an important reality that we see in particular with the case of Ijtihād al-Maqāṣidī (teleological). Indeed, many authors see in the classical theory of the "Higher Objectives of Islamic Law" the keystone of the renewal of Islamic law in modern times. But far fewer have theoretically produced a clear hermeneutical methodology for interpreting texts and law on the basis of the Maqāṣid al-Sharīʿa. Our thesis thus aims to analyze the methodological evolutions and innovations of contemporary Islamic legal hermeneutics by studying in particular a certain number of its mechanisms in a comprehensive and in-depth manner.
