L'analyse est menée au prisme des objectifs d'harmonisation de l'UE relatifs au bon fonctionnement du marché unique de l'UE et la promotion de la capacité d'innovation européenne. Les résultats montrent une harmonisation considérable du système des marques de l'UE, contrairement au système des brevets. Ainsi, la thèse met en lumière des différences entre les pays européens - particulièrement l’Allemagne, la France et le Royaume-Uni - concernant l’organisation de leurs cours de brevet. A travers une analyse de la jurisprudence, d’entretiens d’expert et d’un sondage, l'étude identifie une divergence d’approches des cours nationaux à l'égard des questions de brevets similaires, traitées dans un contexte transfrontalier, causant de la fragmentation du contentieux en matière de brevet européen. Dans ce contexte, la thèse retrace l'émergence de la Juridiction unifiée du brevet (JUB) et examine les questions relatives à son entrée en vigueur, l'organisation interne de ses divisions et instances, son haut degré de spécialisation et sa place dans l'ordre juridique et le système judiciaire de l’UE. Finalement, la thèse présente des réflexions sur un agencement alternatif du système judiciaire européen de brevet afin de parvenir à une plus grande uniformité. Elles impliquent une coopération renforcée entre les juges nationaux à travers la mise en place de lignes directrices européennes, une approche nuancée vis-à-vis de la spécialisation des tribunaux nationaux et, enfin, l’engagement de la CJUE en matière de brevet dans l’UE. The thesis explores pathways to a uniform judicial design in the field of patent law in the European Union. The analysis is conducted in the light of the EU’s harmonisation aims related to the proper functioning of EU’s single market and the promotion of European capacity of innovation. The findings indicate considerable harmonisation of the EU trade mark system, unlike the patent system. Thus, the thesis sheds light on the differences in organisation of patent courts in various European states, with a particular focus on Germany, France and the UK. Based on case-law, expert interviews and a survey, the study identifies the divergence in national courts’ approaches to similar patent matters in a cross-border context, causing fragmentation of European patent litigation. Against this background, the thesis tracks the emergence of the Unified Patent Court (UPC) and examines the issues of its entry into force, the internal organisation of its divisions and instances, its high degree of specialisation and its fit into the legal order and the judicial system of the EU. Finally, the thesis presents reflections on an alternative design for European patent judiciary to achieve greater uniformity. These involve extended cooperation between the national patent judges by establishing European guidelines, a balanced approach towards the patent specialisation of national courts and the engagement of the CJEU in patent adjudication in the EU.
