Le droit à la sécurité et à la santé au travail est en effet traversé de deux dynamiques contradictoires. Après avoir été reconnu comme droit fondamental, sa fondamentalité a été oblitérée sous l’effet de la technicisation du droit et des insuffisances des mécanismes de garantie de sa protection. L’effacement progressif de son caractère fondamental a rendu inadéquats les systèmes de protection pourtant construits en vue d’assurer son efficacité et son effectivité. Ils s’avèrent ainsi inadaptés pour saisir les enjeux juridiques consécutifs de l’accélération de la mondialisation et du dérèglement climatique. The right to safety and health at work, originally enshrined as a fundamental right, has gradually been stripped of its fundamental nature. Paradoxically, it is the law itself which has gradually distorted it. The right to safety and health at work is, in fact, subject to two contradictory dynamics. After having been recognised as a fundamental right, its fundamental nature has been obliterated by the technicalisation of the law and the inadequacies of the mechanisms designed to guarantee its protection. These systems of protection, which were initially built to ensure the efficiency and effectiveness of the right to safety and health at work, have been rendered inadequate by the gradual loss of the fundamental character of this right. They have become inadequate to address the legal issues arising from accelerating globalisation and climate change.
