L’innovation est une notion peu utilisée en droit, le juriste emploie plutôt le terme d’invention, mais elle est courante en économie. Pour innover, l’acteur économique s’appuie sur des antériorités et notamment d’autres innovations techniques. L’innovation ouverte est un changement de paradigme dans les processus d’innovation. La complexification des domaines techniques et leurs interdépendances obligent les acteurs économiques à mutualiser leurs efforts.La thèse analyse les manifestations de ce paradigme en droit en analysant la place de la normalisation technique, en proposant une relecture des conditions d’application des droits de propriété intellectuelle par un critère générique que serait la nouveauté, enfin par une extension de la théorie des facilités essentielles pour décrire différents corps de règles conduisant à ouvrir par le droit notamment des innovations techniques, des données, la science.Innovation, technique, ouverte, standard, norme, facilités essentielles, propriété, intellectuelle.
While common in economics, innovation is a term seldom used in law and generally jurists prefer the notion of invention. Economic actors typically rely on prior art and more typically, existing technology, to create novel innovations. Open innovation is a paradigm shift in innovation process. The increasing complexity of technical fields and their interdependencies are forcing economic players to pool their efforts.This thesis analyzes the manifestation of this paradigm shift in law by considering the effects of technical standardization, proposing a redefinition of the conditions warranting the application of intellectual property rights through a generic criteria of novelty, and extending the interpretation and application of various existing legal code to align with the evolution of technical innovations, datas, and science.
