Les résultats de ces avancées techniques trouvent dès à présent leur place dans une gamme de plus en plus étendue d’applications pratiques. Or, lorsque ces objets constituent des solutions techniques innovantes, ils sont susceptibles d’être protégés par un brevet. Naviguer les méandres techniques et juridiques de la protection d’un objet tel que l’intelligence artificielle par le brevet apparaît comme une gageure alors que les pratiques sont en cours d’élaboration. Mais, les besoins affirmés de l’ensemble de la communauté — industriels, inventeurs, praticiens du brevet, juristes — à cerner les contours d’une telle protection justifient l’exercice. Cette étude vise donc d’abord à cela : éclairer les différentes facettes de la brevetabilité des applications de l’intelligence artificielle en Europe. A new generation of algorithmic tools, commonly grouped under the label of "artificial intelligence" (AI), is today at the heart of an increasing number of products and services. The results of these technical advances are now finding their place in an ever-widening range of practical applications. However, when these objects constitute innovative technical solutions, they are likely to be protected by a patent. Navigating the technical and legal intricacies of protecting an object such as artificial intelligence by patent appears to be a challenge as practices are still being developed. But, the clearly expressed needs of the entire community — industrialists, inventors, patent practitioners, lawyers — to define the boundaries of such protection justify the exercise. This study therefore aims primarily to do this: to shed light on the different facets of the patentability of artificial intelligence applications in Europe.
