La liberté nouvellement conquise laisse s’exprimer des comportements économiques pernicieux. Leurs victimes manifestent un besoin de protection qui se trouve satisfait par les premières lois relatives à la propriété intellectuelle mais également par la théorie de la concurrence déloyale d’origine jurisprudentielle. Cette complémentarité ancienne persiste par l’association récurrente des actions en contrefaçon et en concurrence déloyale au sein des mêmes instances. Ce phénomène est positif s’il s’agit d’une véritable complémentarité ; il inquiète toutefois lorsque l’action en concurrence déloyale vient s’ajouter inutilement à l’action en contrefaçon ou vient se substituer à elle. Cette concurrence est source de tensions dont les ressorts sont perceptibles au stade même de la constitution des droits et se manifestent pleinement lors de leur mise en mouvement dans le cadre du procès civil. The French Revolution sounded the death knell for guilds that regulated economic life. This newly conquered freedom allowed the expression of pernicious economic behaviors. Their victims have a need for protection which is satisfied by the first laws on intellectual property but also by the theory of unfair competition which found its origins in the jurisprudence of the day. The long-standing complementarity between these doctrines persists by the recurring association of an intellectual property infringement action and an action in unfair competition within the same jurisdictions. This phenomenon is beneficial if there is genuine complementarity ; however, it is concerning when an unfair competition action is unnecessarily added to the infringement action or appears to be substitute for it. Their rivalry is a source of tension, whose causes are discernible at the very stage of the constitution of rights and which are manifested when they asserted in civil court.
