Le Traité de Lausanne et la Convention européenne des droits de l’homme (ci-après dénommée la «CEDH») sont des exemples de traités internationaux qui traitent des questions relatives aux droits de l’homme et façonnent le droit national.La thèse porte sur la mise en œuvre des normes des droits de l'homme fixées par le Traité de Lausanne à la lumière des normes et principes de la CEDH, lorsque cela est jugé nécessaire, en se référant au contexte historique et aux évolutions sociales. La thèse vise à aborder l’interprétation et la mise en œuvre du Traité de Lausanne selon la CEDH et la jurisprudence de la CEDH. En particulier, elle explore comment les États parties ont répondu et pourraient répondre aux développements du droit européen des droits de l’homme tout en respectant leurs obligations découlant du traité de Lausanne, elle analyse les façons dont ces deux traités s’articulent en pratique. Cette thèse tente de répondre à la question de savoir si la CEDH est allée bien au-delà en ce qui concerne l’interprétation et l’exécution du Traité de Lausanne dans les ordres juridiques nationaux, en particulier de la Grèce et de la Turquie. Ces deux traités internationaux sont-ils compatibles entre eux ou avec l'interprétation de la Cour européenne des droits de l'homme (ci-après dénommée la «CEDH»)? Certains droits et obligations énoncés dans le Traité de Lausanne sont-ils tombés en désuétude ou sont-ils devenus obsolètes/caducs, et, ratione personae et ratione loci du Traité de Lausanne, sont-ils plus étroits que la CEDH ? Les États respectent-ils les arrêts de la CEDH concernant l’interprétation du Traité de Lausanne, dans quelle mesure et à quelle vitesse? Disposent-ils de mécanismes internes pour se conformer à ces jugements? Il est soutenu dans cette thèse que toute obligation pouvant découler du Traité de Lausanne doit être interprétée et mise en œuvre dans le plein et effectif respect des obligations subséquentes contractées par la ratification de la CEDH. International law plays an important role at the national level and has a clear impact on domestic law. The Treaty of Lausanne and the European Convention on Human Rights (Hereinafter referred as the “ECHR”) are examples of international treaties that deal with human rights issues and shape domestic law. The thesis focuses on the implementation of the human rights standards set by the Treaty of Lausanne in the light of the norms and principles of the ECHR, by referencing, where deemed necessary, to the historical background and social developments. The thesis aims to address the interpretation and implementation of the Treaty of Lausanne according to the ECHR and the case-law of the ECtHR. In particular, it explores how the relevant State Parties can respond and have responded to the developments in European human rights law, while abiding by their obligations arising from the Treaty of Lausanne and, analyzes the ways which these two treaties are in interplay in practice. This thesis attempts to answer the question whether the ECHR went beyond the interpretation and execution of the Treaty of Lausanne in the national legal systems, particularly, of Greece and Turkey. Are these two international treaties compatible with each other or with the interpretation of the European Court of Human Rights (Hereinafter referred as the “ECtHR”)? Have certain rights and obligations set forth in the Treaty of Lausanne fallen into desuetude or are obsolete/caducus and, are ratione personae and ratione loci of the Treaty of Lausanne narrower than the ECHR? Do the States respect the judgments of the ECtHR concerning the interpretation of the Treaty of Lausanne: To what extent and how quickly? Do they have internal mechanisms to comply with these judgments? It is argued in this thesis that any obligation that may arise out of the Treaty of Lausanne should be interpreted and implemented in full and effective compliance with the subsequent obligations undertaken by the ratification of the ECHR.
