Étant donné que les actes jugés étaient des infractions prévues et punies par le Code Pénal, du point de vue juridique ce dispositif était conçu comme une véritable juridiction pénale à vocation rétributive. Toutefois, comme il se voulait également restauratif et pédagogique, la société rwandaise dans toute sa totalité a été amenée à s’y’impliquer activement. C’est ce caractère "exceptionnel" et cette transversalité qui intéressent cette étude. Avec une approche compréhensive, notre recherche consiste à mettre en exergue sa dimension éthique et le rôle qu’il a joué dans la reconstruction des valeurs du vivre ensemble. Following the genocide committed against the Tutsi, in Rwanda, in 1994, the Rwandan government had to invent a model of an exceptional and proximity based justice system, named Gacaca jurisdictions as inspired by the Rwandan tradition. Given that the acts judged were offenses covered and punished by the Penal Code, this system was conceived, from a legal point of view, as a true penal jurisdiction with retributive vocation. However, by also seeking to be restorative and educational, the Rwandan society has been driven to become actively involved as a whole. It is this "exceptional" character and the cross-societal dimension that are the main stake of this study. Following a comprehensive approach, our contribution consists in highlighting its ethical dimension and the role it has played in the reconstruction of the values of living together.
