Succinct, le texte concède au propriétaire une « faveur », qui lui permet d’exercer une prérogative exorbitante du droit commun. Mais du XVIe au XVIIIe siècle, l’interprétation littérale de la loi Æde, combinée à son exégèse, façonnent un dispositif plus acceptable et plus équitable, venant garantir la protection de la jouissance paisible du locataire. Les juristes se livrent en effet à une réflexion visant à assurer l’équilibre de la relation contractuelle entre les parties au bail. Doté d’une qualification juridique, le dispositif évolue, sans pour autant être abrogé. Sous l’influence des idées du temps, le privilège « d’occuper pour soi-même » ou « bourgeois » procède alors d’un régime précisé et ajusté, relativement à son éligibilité, à sa motivation et à son dédommagement. This adage reflects the fact that a legacy of Roman law on residential leases is still in force in the French "Ancien Droit": the owner's right to take back the building he rents in application of the provisions of the Æde law (C., 4, 65, 3). Though short, the text grants the landlord a "favour", enabling him to exercise a prerogative that is exorbitant from common law. However, the literal interpretation of the Æde law from the 16th to the 18th century, together with its exegesis, shaped a more acceptable and equitable system, guaranteeing the protection of a tenant's right to peaceful enjoyment of the rented premises. Lawyers’ reflections were, in fact, aimed at ensuring the fair contractual relationship between the parties to the lease agreement. With its legal qualification, the mechanism evolved, without being repealed. Under the influence of the ideas over time, the privilege of ”occupying for oneself” or the ”bourgeois” privilege has been attributed a more precise and adjusted regime, with regard in particular to its eligibility, its motivation, and its compensation.
