Ce travail analyse les conditions et conséquences de la transformation de la pharmacie d’officine française à l’épreuve de son cadre normatif, relève des ambiguïtés entre catégories, examine leur articulation dynamique, dans une perspective systémique. Pour cela, il rassemble des dispositions éparses des droits sanitaire, de la sécurité sociale, social, comptable et fiscal. Le modèle de création de valeur évolue, l’autorisation de services à orientation clinique induit des catégories légales et contenus conventionnels inédits, quand l’organisation sociale et capitalistique demeure très stable. Nous identifions un revenu tiré des jeux compétitifs de back office, dont la légitimité est contestée, la destination convoitée. L’officine présente une forte sensibilité à ce revenu, fruit de choix de régulation économique. Or, il est une motivation économique sous-estimée du maillage territorial, dont l'utilité a été refondée depuis la loi de 2009, laquelle a élargi le rôle du pharmacien.
The French community pharmacy is evolving. We here analyse the legal conditions and economic consequences of this transformation that raise ambiguities between legal categories and examine their dynamic articulation within a systemic perspective. Our research mobilizes historically scattered provisions from health law, social security law, social law, accounting regulations and tax laws. The value creation model is evolving, the generation of newly, clinically oriented services induce new rules and agreements between pharmacists’ unions and mandatory health insurers, while the community pharmacy’ social and capitalistic organization remains highly stable. The competitive back-office games produce incomes whose legitimacy is disputed, and that are coveted by investors. Pharmacies are highly sensitive to these incomes that are an underestimated but significant economic incentive for maintaining the territorial network, since the 2009 Act that expanded the role of community pharmacists in France.
