La différence entre les deux droits se trouve dans le degré d’admission de l’évolution du litige en appel, qui sera justifiée par la conception de l’appel. Entre trancher le litige définitivement au stade de l’appel pour gagner du temps et imposer un retour à la première instance en cas d’évolution du litige, ce sont les droits des parties qui seront touchés, que soit mise en avant soit la célérité de la justice soit le double degré de juridiction. Aussi, notre étude sera consacrée aux règles applicables quant aux conditions de l’ouverture de l’appel puisque ces conditions affecteront le droit du justiciable quant à son droit d’être jugé devant un tribunal du second degré. La réforme de l’ancien code de procédure civile français de 1806, dont le code de procédure civile koweitien s’est inspiré, a montré qu’il était nécessaire de donner au juge un rôle plus actif ; celui-ci n’a pas évolué en droit koweitien. L'approche comparative entre les deux systèmes juridiques permet une meilleure compréhension du sujet et permet de mettre en lumière les points positifs et négatifs des deux systèmes. Nous ne soutenons pas l’idée de suivre l’évolution français actuel, mais jugeons pertinent de mettre en place des réformes qui garantissent un équilibre entre le rôle du juge et celui des parties pour le bon déroulement de l’instance. This thesis aims to explore the right of appeal and its conception in both legal systems. The difference between the two legal systems lies in the degree of admission of the evolution of the dispute on appeal, which is justified by the conception of appeal. Whether a dispute is finally decided at the appeal stage to save time or whether a case has to be returned to the first instance if the dispute evolves, it is the rights of the parties that will be affected, regardless of how much emphasis is put on either the speed of justice or the double degree of jurisdiction. This study will therefore focus on the relevant provisions as to the conditions under which an appeal may be lodged, as these conditions will affect the rights of litigants as regards their right to be tried before a court of the second instance. Reform of the old French Code of Civil Procedure of 1806, from which the Kuwaiti Code of Civil Procedure drew its inspiration, showed the need for a more active role for the judge; this has not changed in Kuwaiti law. A comparative analysis of the two legal systems allows a better understanding of the subject and highlights the positive and negative aspects of the two systems. While we do not support the idea of following current French developments, we consider it pertinent to introduce reforms that ensure a balance between the role of the judge and that of the parties for the smooth running of the proceedings.
