La compréhension des enjeux de cette articulation ainsi que l’analyse de ses défis actuels s’appuient sur l’étude de la mise en oeuvre des instruments de reconnaissance mutuelle du mandat d’arrêt européen et de la décision d’enquête européenne ainsi que la mise en place du nouveau Parquet européen. La thèse propose un point de vue européen sur la question mais observe aussi la réaction d’autres grands acteurs de la coopération judiciaire pénale, en particulier la Cour européenne des droits de l’Homme et les juridictions constitutionnelles et suprêmes des systèmes français et allemands. This thesis is devoted to the study and criticism of the articulation of the structuring principles of the judicial cooperation in criminal matters as put forward by the CJEU within the AFSJ - the principle of respect for fundamental rights, the principle of primacy of the Union law and the principle of mutual trust - with regard to its objectives of effectiveness, autonomy and validity. The understanding of the stakes of this articulation as well as the analysis of its current challenges are based on the study of the implementation of the instruments of mutual recognition of the European Arrest Warrant and the European Investigation Order as well as the setting up of the new European Public Prosecutor's Office. The thesis offers a European perspective on the issue but also looks at the reaction of other major actors in criminal judicial cooperation, in particular the European Court of Human Rights and the constitutional and supreme courts of the French and German systems.
