Après des essais de modernisation et d’adaptation de la justice marocaine aux exigences de « l’État de droit pour les affaires », la réforme constitutionnelle de 2011 a permis d’établir, pour la première fois, un pouvoir judiciaire indépendant tant au niveau institutionnel qu’au niveau individuel. En partant de l’idée que la justice marocaine a subi des mutations conceptuelles, normatives et institutionnelles dans la nouvelle Constitution de 2011, nous nous sommes intéressées à l’analyse des dynamiques de la circulation des acteurs, des normes et standards internationaux relatifs à l’indépendance de la justice et au mode de gestion de l’administration judiciaire, en rapport avec la réforme judiciaire de 2013. Par l’effet du recours du Maroc aux instruments d’européanisation pour la mise en œuvre des objectifs de la réforme judiciaire, principalement dans son volet lié à l’indépendance judicaire, une forme d’européanisation s’est développée constituant ainsi une nouvelle voie d’internationalisation de l’indépendance de la justice marocaine. L’internationalisation est saisie comme le produit des influences des acteurs européens et internationaux, manifesté au niveau interne par l’appropriation et l’internalisation complète ou partielle des normes et standards internationaux, qu’ils soient impératifs ou principes directeurs des garanties d’indépendance judiciaire ; alors que l’européanisation désigne le processus d’adaptation qui a conduit le Maroc à s’approprier des normes et standards internationaux et européens par voie de recours aux instruments européens de jumelages institutionnels et d’assistances juridiques. Ce processus d’européanisation, reflète une démarche singulière d’un rapprochement délibéré du système judiciaire marocain, aux principes et standards européens et internationaux, en partie comme action de légitimation de l’Union européenne et du Conseil de l’Europe dans le cadre des politiques de voisinage méditerranéen. L’européanisation pour notre recherche n’est donc qu’un moyen, outil d’adaptation aux principes et standards internationaux d’un système établi, non européen, et non pas un objectif en soi, et l’effet qui se produit est l’internationalisation. In the era of globalization, this thesis examines the dynamics of the internationalization and Europeanization of judicial independence in Morocco. After attempts to modernize and adapt Moroccan justice to the requirements of the “rule of law for business”, the constitutional reform of 2011 made it possible to establish, for the first time, an independent judiciary at both institutional and individual level. Starting from the idea that Moroccan justice has undergone conceptual, normative and institutional mutations in the new Constitution of 2011, we are interested in analyzing the dynamics of the circulation of actors, international norms and standards relating to the independence of the judiciary and the mode of management of the judicial administration, in relation to the judicial reform of 2013. Morocco's use of Europeanization instruments to implement the objectives of its judicial reform, mainly in the area of judicial independence, has led to the development of a form of Europeanization, constituting a new means of internationalizing the independence of the Moroccan judiciary. Internationalization is understood as the product of the influences of European and international players, manifested at domestic level by the appropriation and full or partial internalization of international norms and standards, whether imperative or guiding principles of guarantees of judicial independence, while Europeanization refers to the process of adaptation that has led Morocco to appropriate international and European norms and standards through recourse to European instruments of institutional twinning and legal assistance. This process of Europeanization reflects a singular approach to deliberately bringing the Moroccan judicial system closer to European and international principles and standards, partly as a means of legitimizing the European Union and the Council of Europe within the framework of Mediterranean neighbourhood policies. For our research, Europeanization is therefore only a means, a tool for adapting an established, non-European system to international principles and standards, and not an objective in itself; and the effect that is produced is internationalization.
