<dcterms:abstract xml:lang="fr">À l’heure où l’entreprise tend à maximiser le bien-être et la qualité de vie des conditions de travail, la souffrance au travail persiste. L’objectif de cette thèse est de (re)considérer la souffrance au travail à l’égard de ses manifestations pour permettre aux managers, RH, médecins du travail et aux juges de disposer d’un processus d’interprétation pluridisciplinaire en quatre étapes : définir, identifier, reconnaitre et résoudre une situation de souffrance au travail. Le cadre d’analyse adopté repose sur la théorie du contrat psychologique dont la violation peut conduire à une souffrance au travail. Notre méthodologie mobilise une approche qualitative et une triangulation de données : 314 arrêts de la Cour de cassation, 320 conventions et accords collectifs et 32 entretiens semi-directifs. Les contributions de ce travail développent une définition à la croisée du droit et de la gestion, puis proposent un modèle d’identification et de prévention primaire ainsi que des solutions juridico-gestionnaires en cas de souffrance au travail.</dcterms:abstract>
<dcterms:abstract xml:lang="en">At a time when companies are striving to maximize well-being and quality of life in the workplace, suffering persists. The aim of this thesis is to (re)consider suffering at work in terms of its manifestations, so as to provide managers, HR staff, occupational physicians and judges with a multidisciplinary interpretation process involving four stages: defining, identifying, recognising and resolving suffering at work. The analytical framework adopted is based on the theory of the psychological contract, the breach of which can lead to suffering at work. Our methodology uses a qualitative approach and a triangulation of data: 314 Court of Cassation rulings, 320 collective agreements and 32 semi-structured interviews. The contributions to this work develop a definition at the crossroads of law and management, and then propose a model for identification and primary prevention, as well as legal and managerial solutions in the event of suffering at work.</dcterms:abstract>
