Il s’agissait notamment d’examiner l’action en concurrence déloyale comme moyen de protection des créations immatérielles, complémentaire à l’action en contrefaçon. La question étant plus précisément de savoir si le cumul des deux actions était possible. Nous avons pu constater que celui-ci était admissible dans son principe. L'action en concurrence déloyale peut en particulier, être exercée à titre complémentaire de l’action en contrefaçon, sauf en matière de techniques non brevetées ou secrètes. Le secret étant par définition caché, il ne saurait y avoir ici matière à concurrence déloyale, mais plutôt la mise en cause de la responsabilité civile et pénale de l'auteur de l'atteinte au secret des affaires. Our research work is a comparative study of French and Kuwaiti rights, in terms of civil protection of immaterial creations. Our purpose was in particular examining unfair competition action as a way of protecting immaterial creations, complementary to counterfeiting action. The question being more precisely whether the combination of the two actions was possible. We were able to see that this was admissible in principle. The action for unfair competition may in particular be brought in addition to the action for infringement, except in matters of nonpatented or secret techniques. Since secrecy is by definition hidden, there cannot be any ground for unfair competition in this field, only civil and criminal liability of the author of the violation of business secrecy.
