La problématique qu’elle soulève prend racine dans l’ambiguïté entourant cette notion et dans l’absence de consensus quant à sa définition.Menée selon une approche comparative, cette recherche vise à cerner la portée du déni de justice, à en préciser la signification et à retracer les étapes de son évolution, en examinant tout à la fois le rôle du législateur dans l’apparition de ce concept et l’apport de la doctrine ainsi que de la jurisprudence — tant nationale que supranationale — dans l’extension de son champ d’application.L’étude conclut que l’interdiction du déni de justice a d’abord été perçue comme un simple instrument de transfert du pouvoir interprétatif et créateur du législateur vers le juge, puis comprise comme une violation des devoirs fondamentaux incombant à ce dernier en raison de sa fonction, avant d’être considérée comme une atteinte au droit au juge.Enfin, il apparaît que la compréhension approfondie et la définition précise de la notion de déni de justice peuvent inciter les chercheurs à s’interroger sur les causes juridiques et factuelles de ce phénomène, et à proposer des solutions efficaces afin d’en réduire l’occurrence ou d’en atténuer l’impact dans la pratique. This study analyzes, in chronological order, the evolution of the concept of denial of justice. The issue addressed arises from the ambiguity surrounding this notion and the lack of consensus regarding its definition.Conducted using a comparative approach, this research seeks to delineate the scope of denial of justice, clarify its meaning, and trace the stages of its evolution by examining both the role of the legislator in the emergence of this concept and the contribution of legal doctrine as well as case law -at both national and supranational levels -in broadening its field of application.The study concludes that the prohibition of denial of justice was initially perceived as a mere instrument for transferring the legislator’s interpretive and creative power to the judge, then understood as a violation of the fundamental duties incumbent upon the latter by virtue of judicial office, before being regarded as an infringement of the right to a judge.Finally, it appears that a thorough understanding and precise definition of the notion of denial of justice may prompt researchers to examine the legal and factual causes of this phenomenon, and to propose effective solutions to reduce its occurrence or mitigate its practical impact.
