<dcterms:abstract xml:lang="fr">L’étude propose une analyse approfondie de la hiérarchie du ministère public en droit français, envisagée à la lumière du droit allemand et des exigences contemporaines de la politique pénale dans un État de droit. Elle s’inscrit dans un contexte marqué par des interrogations récurrentes sur le positionnement institutionnel du parquet, son rattachement à l’exécutif et la compatibilité de son statut avec les principes d’indépendance et d’impartialité de la justice, tels qu’ils sont notamment consacrés par la Convention européenne des droits de l’homme. La recherche met en évidence la nécessité de concilier deux impératifs structurellement complémentaires mais juridiquement sources de tensions. D’une part, l’autorité du ministre de la Justice apparaît comme un élément central de la cohérence de la politique pénale, seul à même d’en assurer la définition, la conduite et la responsabilité politique devant le Parlement. D’autre part, l’autonomie fonctionnelle des membres du ministère public s’avère indispensable à l’exercice de l’action publique et au respect des garanties procédurales. L’analyse retrace les évolutions normatives, jurisprudentielles et doctrinales qui ont marqué l’histoire récente du parquet français, en particulier les réformes relatives aux instructions individuelles, à la carrière des procureurs et à la place du garde des sceaux. La comparaison avec le modèle allemand, fondé sur une subordination hiérarchique assumée du parquet à l’exécutif mais strictement encadrée, permet d’éclairer les choix français et d’en révéler les ambiguïtés. L’étude esquisse enfin des pistes de réforme visant à repenser la place du ministère public dans l’ordre institutionnel et à déterminer le juste degré de hiérarchie compatible avec l’État de droit.</dcterms:abstract>
<dcterms:abstract xml:lang="en">The study offers an in-depth analysis of the hierarchy of the public prosecutor's office in French law, considered in the light of German law and the contemporary requirements of criminal policy in a state governed by the rule of law. It comes at a time of recurring questions about the institutional positioning of the public prosecutor's office, its attachment to the executive branch and the compatibility of its status with the principles of independence and impartiality of the judiciary, as enshrined in particular in the European Convention on Human Rights.The research highlights the need to reconcile two imperatives that are structurally complementary but legally sources of tension. On the one hand, the authority of the Minister of Justice appears to be a central element in the coherence of criminal policy, as he or she is the only one capable of defining and conducting it and of assuming political responsibility for it before Parliament. On the other hand, the functional autonomy of members of the public prosecutor's office is essential to the exercise of public action and respect for procedural guarantees. The analysis traces the normative, jurisprudential and doctrinal developments that have marked the recent history of the French public prosecutor's office, in particular the reforms relating to individual investigations, the career of prosecutors and the role of the Minister of Justice. A comparison with the German model, based on the open but strictly regulated hierarchical subordination of the public prosecutor's office to the executive, sheds light on the French choices and reveals their ambiguities. Finally, the study outlines avenues for reform aimed at rethinking the place of the public prosecutor's office in the institutional order and determining the appropriate degree of hierarchy compatible with the rule of law.</dcterms:abstract>
