<dcterms:abstract xml:lang="fr">Historiquement focalisé sur des interdictions générales (obligations négatives), le droit internationalconnaît un renversement paradigmatique : les États ne doivent plus seulement s’abstenir de porteratteinte aux droits des minorités, mais ils sont désormais tenus d’agir activement pour garantir leurprotection. La technique des obligations positives s’impose aujourd’hui comme un tournant majeurdu droit international contemporain, en particulier dans le champ de la protection des droits del’homme. Cette approche, centrée sur une lecture dynamique et évolutive des obligations étatiquespar les organes internationaux de protection des droits de l’homme, joue un rôle essentiel dans lapréservation de l’identité minoritaire. Ce développement s’inscrit dans le renforcementinstitutionnel du système international : la création d’organes de contrôle des droits de l’homme, etla mise en place de mécanismes de suivi permettent non seulement de surveiller les engagementsdes États, mais aussi de compléter et préciser leur contenu. Ensemble, ils contribuent à l’élaborationd’une jurisprudence et d’une pratique internationale cohérente, qui favorise une meilleure prise encompte des droits des minorités et une protection plus substantielle de leur identité. En somme, latechnique des obligations positives, à la croisée du juridique et de l’institutionnel, représente uninstrument clé pour renforcer la protection internationale des minorités dans un cadre fondé sur lesdroits de l’homme, l’action étatique et la coopération multilatérale.</dcterms:abstract>
<dcterms:abstract xml:lang="en">Historically focused on general prohibitions (negative obligations), international law is undergoinga paradigm shift: states must no longer merely refrain from infringing on the rights of minorities,but are now required to take active steps to ensure their protection. The technique of positiveobligations is now emerging as a major turning point in contemporary international law, particularlyin the field of human rights protection. This approach, centered on a dynamic and evolvinginterpretation of state obligations by international human rights bodies, plays an essential role inpreserving minority identity. This development is part of the institutional strengthening of theinternational system: the creation of human rights monitoring bodies and the establishment offollow-up mechanisms not only make it possible to monitor states' commitments, but also tosupplement and clarify their content. Together, they contribute to the development of consistentinternational jurisprudence and practice, which promotes greater consideration of minority rightsand more substantial protection of their identity. In short, the technique of positive obligations, atthe crossroads of law and institutions, represents a key instrument for strengthening theinternational protection of minorities within a framework based on human rights, state action, andmultilateral cooperation.</dcterms:abstract>
