Cette réforme a consacré l’émergence d’une fonction médiationnelle inédite, parfois perçue comme paradoxale au regard des attributions traditionnelles du juge. La présente thèse se propose d’en analyser les fondements juridiques ainsi que les modalités concrètes d’exercice, afin d’en apprécier la cohérence et la portée. Elle établit que cette fonction, loin de rompre avec la mission juridictionnelle du juge administratif, s’inscrit dans une dynamique de continuité et d’adaptation aux enjeux contemporains de la justice administrative. Elle met surtout en évidence que le développement effectif de la médiation administrative repose largement sur l’engagement actif du juge administratif. À partir de l’analyse des pratiques institutionnelles et jurisprudentielles, la thèse formule un ensemble de recommandations — internes et externes à la juridiction administrative — destinées à consolider le cadre juridique et opérationnel de la médiation, et à en promouvoir une mise en œuvre plus ambitieuse, cohérente et efficiente. The Act of 18 November 2016 on the Modernisation of Justice in the Twenty-First Century constitutes a decisive milestone in the evolution of administrative mediation, redefining the role of the administrative judge, who is henceforth involved in the mediation process in its entirety. This reform has brought about the emergence of an unprecedented mediation function, at times perceived as paradoxical in light of the judge’s traditional mission. This dissertation seeks to analyse the legal foundations and the practical modalities of this function, in order to assess its coherence and scope. It demonstrates that this function, far from departing from the judicial mission of the administrative judge, forms part of a dynamic of continuity and adaptation to the contemporary challenges of administrative justice. It further underscores that the effective development of administrative mediation depends to a large extent on the active engagement of the administrative judge. Drawing on an analysis of institutional practices and case law, the dissertation formulates a set of recommendations—both internal and external to the administrative courts—aimed at consolidating the legal and operational framework of mediation and at promoting its implementation in a more ambitious, coherent, and effective manner.
