À la croisée du droit de l’environnement, de l’innovation et de la régulation des risques, sa mise en œuvre traduit un double mouvement : exigence accrue de responsabilité en contexte d’incertitude et appel à l’expérimentation normative favorisant l’émergence de solutions innovantes. En s’émancipant d’une lecture restrictive, il devient un levier d’action face aux risques graves et irréversibles pour l’environnement et la santé, et participe au renouvellement des cadres juridiques dans une logique de prévention et d’anticipation. Il légitime ainsi des mesures provisoires, proportionnées et évolutives soutenant la recherche et l’innovation verte. Cette thèse en fait un outil structurant de la transition écologique, fondé sur un droit de l’innovation où l’incertitude devient le moteur. The deconstruction of the precautionary principle undertaken in this dissertation shows that it can be understood not as an impediment to innovation, but as a catalyst for ecological and technological transformations. Situated at the intersection of environmental law, innovation, and risk regulation, its implementation reflects a dual movement: an increased demand for responsibility in contexts of uncertainty, and a call for normative experimentation fostering the emergence of innovative solutions. By moving beyond a restrictive interpretation, it becomes a lever for action in the face of serious and irreversible risks to the environment and human health and contributes to the renewal of legal frameworks within a logic of prevention and anticipation. It thus legitimizes provisional, proportionate, and adaptive measures that support research and green innovation. This dissertation presents it as a structuring tool of the ecological transition, grounded in an innovation-oriented legal framework where uncertainty becomes the driving force.
