Pour ce faire, l’étude se penche sur le rôle des mouvements sociaux à impact constitutionnel, c’est-à-dire les mouvements répondant à une logique ascendante et dont le but principal est d’influencer significativement la matière constitutionnelle, dans les systèmes juridiques colombien, équatorien, bolivien et chilien. D’abord, ce travail consiste à analyser la revendication formelle d’une nouvelle constitution par les mouvements et leur volonté de déclencher un processus de refonte constitutionnelle. De la sorte il s’agit de démontrer qu’ils se sont révélés être un facteur de réappropriation du pouvoir constituant par les populations. Ensuite, l’ambition de cette recherche est de déterminer le rôle des mouvements sociaux dans l’impulsion des droits constitutionnels. Le défi de tout processus constituant étant la mise en œuvre et l’interprétation du nouveau texte, il s’agit de mettre en exergue que la suite de la lutte des mouvements s’est dirigée vers cette question. The objective of this thesis is to deepen the understanding of the relationship between constitutional law and mobilization dynamics within the specific context of South America. To this end, the study focuses on the role of social movements with constitutional impact—those movements that follow a bottom-up logic and whose primary goal is to significantly influence constitutional matters—in the legal systems of Colombia, Ecuador, Bolivia, and Chile.Firstly, this research aims to analyze the formal demand for a new constitution by these movements and their intention to initiate a process of constitutional reconstruction. In doing so, it seeks to demonstrate that these movements have proven to be a driving force behind the reappropriation of constituent power by the people. Secondly, the ambition of this study is to determine the role of social movements in advancing constitutional rights. Given that the challenge of any constituent process lies in the implementation and interpretation of the newly adopted text, the focus of this work is to highlight how the movements’ continued struggle has progressively centered on this issue.
