En droit français, de telles opérations peuvent être réalisées au moyen d'instruments juridiques très divers, entraînant l'application de différents régimes juridiques qui offrnt d'inégales garanties face aux risques inhérents aux opérations de PPP. La thèse démontre que ces instruments forment ensemble une classe particulière de contrats de l'Administration, appelant l'émergence d'un régime juridique à la fois commun et spécifique. Analysant le désordre du droit positif, la première partie de la thèse montre qu il participe d'un phénomène plus général de diversification, qui destabilise la conception des contrats administratifs comme les instruments spécifiques et prédéterminés des différents mode de gestion du service public. Elle souligne ainsi le besoin d'une théorie générale des contrats spéciaux de l'Administration, qui est la perspective dans laquelle s'inscrit la mise en ordre opérée par la deuxième partie. En recourant notamment à l'analyse économique, celle-ci vérifie d'abord la possibilité de forger une véritable notion de partenariat public-privé, avant de démontrer que l'émergence d'un régime juridique commun à l'ensemble de ces opérations permettrait d'obtenir une meilleure cohérence globale du droit positif. Plus généralement, la démarche adoptée revient à différencier les contrats selon le type d'opération socio-économique qui constitue leur objet. Public-private partnerships (PPP) consist, for public authorities, in entrusting firms with total or partial financing, with the realisation and maintenance or exploitation of assets allocated to public activities. In French law, such operations can be achieved by means of diverse legal instruments, leading to the application of different legal regimes which offer varying guarantees with regards to the risks inherent to PPP operations. The thesis demonstrates that together these instruments form a particular class of public contracts, calling for the emergence of a both common and specific legal regime. Analysing the disorderliness of positive law, the first part of the thesis shows that it participates in a more general phenomenon of diversification, which destabilizes the conception of administrative contracts as specific and predetermined instruments of the different organization modes of public service. In this way, it underlines the need for a general theory of special public contracts , which is the perspective held for the restoring to order carried out in the second part of the thesis. By resorting notably to economic analysis, this part first establishes the possibility of creating a real concept of public-private partnership, and then demonstrates that the emergence of a legal regime shared by all PPP operations would make it possible to obtain a better global coherence of the positive law. More generally, the reasoning adopted amounts to differentiating between the contracts according to the type of socio-economic operation which constitutes their object.
